Impeachment in The Courts – HJC vs DOJ Appellate Arguments Scheduled for November 12th…

If the HJC loses this case in the DC Appellate Court, it means there is no constitutional foundation recognized to the “impeachment inquiry.”

Without the constitutional recognition of the judicial branch then: (a) Pelosi/Lawfare have to restart the process with a genuine House vote; or (b) the ongoing impeachment process will have no recognized constitutional standing; and (c) the Senate could ignore any House impeachment vote, cast without recognized constitutional standing.

A court initially gave the House Judiciary Committee authorization for the purpose of issuing subpoenas. That authorization was presumptive to the House acting constitutionally in it's process to impeach Donald Trump. DOJ lawyers are arguing that's not the case here. This is now on appeal before a thee judge panel and if they decide/agree that the Democrats have gone off the rails with their secret tribunal and secret witnesses and secret evidences, this could be embarrassing for Team Pelosi and wild eyed Schiff.

If the three judge panel doesn't agree that the HJC is acting constitutionally, they will withdraw the court's authorization to issue subpoenas. The "strongly worded letters that they, the HJC, have already sent out to Trump Administration Officials WILL HAVE NO FORCE OF LAW behind them.

If the Democrats wish to advance impeachment then they will have to do it the old fashioned way. They will have start over and put it to a House vote.
